This is OCF's policy on copyright violations, as approved by the general membership on September 27, 2007.
Policy on copyright violations
Use of OCF resources to obtain, store, or redistribute files in violation of copyright laws is illegal and will not be tolerated.
If a user receives a DMCA takedown notice for copyright infringement for the first time, the user will be sent a notice asking that the offending files be removed immediately. The user will have a grace period of a week to take down the files or contest the issue. If the user does not give an adequate response by the end of the grace period, the user's account will be disabled until the matter is resolved. If it is demonstrated beyond a reasonable doubt(*) that the actions in question were infringing, the user must meet with the Site Manager to receive a warning in person [regardless of whether or not an adequate response was received from the user within the grace period], and must acknowledge in writing the receipt of this warning.
If a user receives another takedown notice after the first offense, the user will again be given a grace period of a week to respond; if no response is received within the grace period, the user's account will be disabled until the matter is resolved. If it is demonstrated beyond reasonable doubt that the actions in question are infringing, his or her account will be disabled permanently.
If OCF staff become aware of a user violating copyright laws, the user may be treated as having received a takedown notice and be subject to the same consequences. Whether or not this occurs will be left up to the root staff. If a consensus cannot be reached, then a majority of the root staff must agree.
(*) For clarity, elimination of reasonable doubt involves consideration of all relevant evidence, including that presented by the user.
